The successful resolution of commercial disputes sometimes requires the addition of a consulting expert to the dispute team to provide another level of expertise and strategic advice without compromising the independence and objectivity required of a testifying expert during both the negotiation process as well as at trial.
TESTIFYING EXPERT
The disclosure of a report from a qualified, independent, objective, testifying accounting expert can be persuasive from the early stages of a dispute through to mediation and trial. The accounting expert’s report and testimony must be clear, concise, and pertain only to the expert’s area of expertise. The expert’s focus must be on “Making it Simple”.

Industry – Agriculture
MRM was retained to act as an expert witness for a multinational agricultural company. MRM prepared a report for the plaintiff relating to damages caused to its 55 acre vegetable crop resulting from a fire that took place on an adjacent property. MRM calculated the revenues and expenses related to the crop had the fire not occurred as well as any cost savings enjoyed by the plaintiff. The matter which had been in litigation for 6 years settled after the MRM report was issued.

MRM was retained to provide an opinion on the Standard of Care applicable to a firm of Chartered Accountants when performing a Notice to Reader engagement.
